Terms of sale

The following general terms and conditions apply to the sale of products and other movable property (hereinafter referred to as “products”) by Embreis AB (hereinafter referred to as “the Seller”) unless something to the contrary has specifically been agreed in writing between the customer (hereinafter referred to as “the Customer”) and the Seller. In conjunction with sales to consumers, the Seller applies the mandatory rules prescribed by applicable legislation.

Order

The products are ordered via the Seller’s website, telephone or email. When an order is placed, a contract is not entered into until the Seller has confirmed the order by way of an order confirmation sent via email. The Seller does not enter into contracts with minors (persons under the age of 18) without the approval of an appropriate legal guardian. The Seller accepts no liability for errors in information or errors in specifications in relation to any products and services included in the Seller’s product range. All images and other visual information should be viewed as illustrations only and cannot be guaranteed to reproduce the exact appearance and nature of the goods in question. In the event of any errors or inaccuracies in the publication or notification of stock status, the Seller reserves the right to correct such errors or inaccuracies after they have been discovered. This means, inter alia, that if a product in the Seller’s product range has been discontinued or is not available for some other reason, despite reasonable efforts, the Seller is not obligated or liable to provide such product, even though the Customer may have ordered the product in accordance with the above.

Terms of delivery

The Seller delivers all products in collaboration with the freight forwarders PostNord (Posten), DHL and FedEx. Exceptions may apply in connection with large deliveries. The delivery time is normally 1-3 working days but may vary depending on product type. If an order includes items that are not in stock (i.e. items that must be ordered from the Seller’s suppliers), the Seller will await delivery of such items from its suppliers before delivering the order to the Customer. If the Seller is unable to deliver the entire order within 14 days, the Seller will make partial delivery of the order at no extra cost to the Customer.

The Customer must always display valid ID in connection with handover/delivery of the products. If a delivery delay arises, the Seller will notify the Customer of the delay via email. The Customer always has the right to cancel an order in the event of a lengthy delivery delay. Cancellation of an order must be advised in writing via letter or email. In such case, the Seller will refund any payment already received from the Customer within 30 days of receipt of the written cancellation. There may be circumstances in which it is impossible for the Seller to complete an order, for example if the Seller’s supplier is unable to fulfil their undertakings in relation to the Seller. Consequently, the Seller accepts no liability in relation to any claims for compensation or damages from the Customer in connection with delivery delays.

The Seller is responsible for the transport risk, in other words, the risk of a product getting damaged or lost during transportation to the Customer. The Customer is responsible for such risk in connection with any product returns to the Seller.

The Customer is obligated to report any transport damage to the Seller’s customer service department within seven working days of the date on which the goods were received. The Customer is thus responsible for removing the packaging and inspecting the condition of the product as soon as possible after receipt of the delivery.

In the event of transport damage, the product may not be used by the Customer, and the Customer must also retain the product’s packaging so that it can be inspected during processing of the claim for transport damage.

Prices and payment

All prices, charges and fees specified on the Seller’s website are stated exclusive of VAT. The amount of VAT and any freight costs will be confirmed prior to confirmation of the purchase.

Unless otherwise agreed, the payment terms are 30 days net from the invoice date.

The Seller accepts no liability for errors, misprints or technical issues in connection with the publication or notification of prices, and reserves the right to declare any obviously incorrect orders null and void.

Warranty, complaints and returns

In connection with complaints and warranty-related matters, the Customer is obligated to report the defect as soon as possible via email to info@embreis.com, and to thereafter follow the Seller’s instructions. Once the Seller has received the returned goods, the Seller will process the matter within 30 days. The Seller will reimburse the Customer for any freight costs in connection with an approved complaint/return.

A service issue arising in connection with a defect, damage, etc. that has occurred for some other reason must be paid for by the Customer, in accordance with the rules prescribed in the Swedish Sale of Goods Act.

Returns

Incorrectly ordered or incorrectly delivered goods must be returned within 30 days from the delivery date, if there is no other agreement. When returning products, we need to have the article number and invoice number emailed to us or attached to the product. You will find our return forms here.

For returned, unused goods or returns for exchange:

  • Older than 30 days from the delivery date, an administration and handling fee of 20% of the invoicing value is invoiced.
  • Older than 90 days from delivery date, goods are not returned.
  • Special and custom-made products are not returned.
  • For damaged packaging, a deduction of 20% of the product value is made. Goods are credited provided that the product is unused and the associated product packaging is undamaged and is in salable condition.

Force Majeure

The Seller is released from fulfilling its obligation to the Customer if non-fulfilment of the obligation is due to amended legislation, decision or action by a competent authority, labour market conflict, fire, flood, war, terrorism, sabotage, major accident or some other such circumstance.

Disputes and choice of law

Swedish law applies to these Terms of Sale. In the event of a dispute, we follow the recommendations of the Swedish National Board for Consumer Disputes (ARN).
